Sentencing delayed as man agrees to testify against suspect in triple murder

SALT LAKE CITY – The sentencing hearing for a man who was charged in connection with a triple murder in Midvale has been delayed, as the suspect agreed to testify against another man charged in the case.

Officials said Davis Fotu, who was charged with obstruction of justice in the case, agreed to testify against David Fresques—the man chargedwith murdering three people last February.

Prosecutors have agreed to seek only probation when it comes to Fotu’s sentence as a result of the deal.

Attorney Rudy Bautista spoke about the deal and Fotu’s alleged reluctance to cooperate initially.

‘He [Fotu] realizes his involvement after the fact,” he said. “But he was absolutely scared with what was going on. There was a potential that his life may be put at risk.”

The sentencing date has been moved to March 28.
