FARMINGTON, Utah — The driver of an ATV involved in a fatal accident in Farmington Canyon has been arrested and charged with automobile homicide.
Authorities say the driver, Matthew Murphy, 40, had been drinking before his ATV rolled over on Sept. 12, killing his passenger, Trevor Dykes. Murphy told police he had been drinking and a Davis County Sheriff's Office deputy smelled alcohol on his breath.
After being transported to the hospital, Murphy's blood alcohol content level was measured at .11, which exceeds the legal limits.
Murphy was taken into custody on Oct. 7 and jailed.
