Man arrested on suspicion of aggravated burglary, kidnapping charges

CLINTON, Utah — A man allegedly involved in a home burglary where two people were duct taped to kitchen chairs was booked into jail on aggravated burglary and kidnapping charges.

dressed in black with their faces painted black, according to a probable cause statement from Clinton police.

The statement indicates Martinez assisted in binding a pregnant woman and 10-year-old boy to kitchen chairs using duct tape.

“The duct tape was secured around their torso and eyes,” according to the statement.

Martinez and the two men went through the residence and stole several items including a large TV, game console and gold coins.

The statement indicates the suspects threatened the woman to not report the incident or they would be back.

“The female was sexually assaulted by one of the other suspects while bound to the chair with duct tape,” according to the statement.

The woman and the boy were able to break free from the duct tape and contact police after Martinez and the two suspects left, the statement indicates.

Martinez’s fingerprints were discovered after an analysis was conducted by the Davis County Sheriff’s Office Crime Lab on a roll of duct tape left at the scene.

It was also discovered, the statement indicates, that Martinez was a family friend to the victims.

Detectives made contact with an acquaintance of Martinez’s in an attempt to find him for questioning.

“Once confronted he confessed to them his involvement in the incident,” according to the statement.

On March 7, Martinez went to the Clinton police station and waived his Miranda Rights.

“Luis Martinez admitted to his involvement and specific role in the incident,” the statement indicates. “Martinez stated he went to the residence with the intent of assaulting the homeowner, prepared with bats and duct tape.”

Martinez was booked in the Davis County Jail on two counts of aggravated kidnapping, a first-degree felony, and aggravated burglary, also a first-degree felony.

The two other suspects in the alleged crime have not yet been identified.
