New lawsuit filed against Brianne Altice over sex with students

SALT LAKE CITY — A teenage boy and his family have leveled a lawsuit against ex-Davis High School teacher Brianne Altice and the Davis School District, seeking more than $1 million in damages.

The lawsuit, filed in federal court on Tuesday, accuses Altice and the school district of negligence saying they “owed a duty to (the boy) and his parents to protect and ensure (his) safety while in the custody and control of DHS.”

FOX 13 typically does not name the victims of sex abuse cases and is not publishing the teen’s name, even though he is a plaintiff in the lawsuit against Altice and Davis School District.

Altice pleaded guilty to forcible sex abuse, admitting to having inappropriate relationships with three students at Davis High, where she taught. She was sentenced to serve up to 30 years in prison and will have her first parole hearing in 2017.

A similar lawsuit was filed in state court, but was challenged over governmental immunity claims. A lawsuit filed by another victim was recently dismissed.
