Utah Supreme Court may drop Allgier appeal

SALT LAKE CITY — The Utah Supreme Court appears ready to drop an appeal by convicted cop-killer Curtis Allgier.

The state’s top court had scheduled arguments in Allgier’s appeal for Wednesday, but then stated it would not conduct oral arguments. The court said Allgier could file written briefs in his appeal, but a spokeswoman for the Utah State Courts said Tuesday he had not filed a timely brief.

Earlier this year, the Utah Supreme Court made an extraordinary ruling when it declared that Allgier had lost his right to an attorney because he had made threats involving them. In its January ruling, the court said Allgier had also stated of his lawyers:

“they [Mr. Allgier’s appointed attorneys] are the dumbest ass clowns I’ve ever had the EXTREME dishonorable displeasure of being forced to know were even somehow on the planet, let alone incompetently and ineffectively misrepresented by[,] and NEVER . . . will they have the honor of being in my Aryan GOD presence or having any kind of contact with me period!!”

Allgier, a white supremacist known for the tattoos covering his face and body, is appealing his plea deal to the murder of Utah State Corrections Officer Stephen Anderson during an escape attempt in 2007.
