Utah corrects errors in court filing over same-sex marriage

ST. GEORGE — The state of Utah has asked the 10th Circuit Court of Appeals to allow it to refile its latest brief in the case involving same-sex marriage, submitting a five-page list of typographical, punctuation, citation and other minor errors in the original filing.

“Plaintiffs do not oppose this request,” special assistant Utah Attorney General Gene Schaerr wrote.

The original reply brief was 12,000 words in length. Such a filing correcting minor errors is not uncommon in cases like this, Utah Attorney General’s spokeswoman Missy Larsen said Wednesday.

There was nothing substantive corrected, she noted.

The state is appealing a federal judge’s decision to overturn Amendment 3, which bans same-sex marriage in the state. U.S. District Judge Robert Shelby’s December ruling cleared the way for an estimated 1,300 same-sex couples to wed in the state.

The 10th U.S. Circuit Court of Appeals in Denver is slated to hear arguments in the case on April 10.
