Layton Landlord offers ultimatum: quit smoking or move

LAYTON, Utah - The Landlord of the Skyline View Apartments in Layton has given tenants six months to either quit smoking or move out.

Randy Banks has managed the complex for 37 years, and plans to implement the smoking ban on November 1st. He says once in effect, smoking will not be allowed indoors or outside at the 111 unit complex.

Banks tells Fox 13 he's concerned for the health of children in the area, and grieving the death of one of his tenants who died of lung cancer in April.

Some long-time residents like Randy Batchelor who lives at Skyline with his fiance and two teenage children are unhappy and say they plan to move out.

The apartment complex does have subsidized housing for those who qualify for assistance from the U.S. Department of Housing and Urban Development (HUD).

Several public housing authorities which get funding from HUD have implement smoke-free policies in Utah. Typically not allowing smoking indoors, and often designating smoking areas outdoors.

The Utah Indoor Clean Air Act currently bans smoking within 25 feet of any entrance-way, exit, open window or air intake of buildings where smoking is prohibited. It also establishes the rights of owners to bar smoking anywhere on their property.
