Jimmer Fredette sues Utah company over endorsement contract

SALT LAKE CITY — Jimmer Fredette, who played basketball with BYU before joining the Sacramento Kings in the NBA, has filed a lawsuit against a clothing company he said did not honor a contract between him and them.

In the complaint, Fredette claims that Black Clover Enterprises failed to pay him the promised amounts, and that they used his likeness without his permission.

According to court documents, Fredette is seeking at least $50,000, as well as interest, attorney fees and other court costs. The lawsuit was filed in the 3rd District Court in Salt Lake City on Monday.

Fredette claims that he and Black Clover made an agreement that would allow the company to use his name and likeness in advertising, promotional campaigns and on products. Fredette said part of the agreement included provisions requiring him to make an appearance for the company, tout their products and provide signed products to the company.

In exchange, the company agreed to pay Fredette $50,000 annually—half due at signing and the rest to come within six months, according to the lawsuit. The deal also included a royalty for Fredette on products he endorsed, free products for Fredette and his agent, and discounts for Fredette’s friends and family.

Fredette said Black Clover did not pay the promised amount, and he said the company used his likeness despite not paying him.
