It happened Wednesday night at 120 North 1660 West in West Point. Davis County investigators say the victims, two boys ages 4 and 10, were stabbed to death.

“It’s so unfathomable that something like this could happen,” said next door neighbor Ken Hall.

Hall watched as a memorial with cards, flowers, balloons and teddy bears grew outside the West Point home. Hall’s children used to play with the victims.

“I’ve known these kids since they moved in. I can’t imagine what their mother is going through,” Hall said.

Emotions ran high as investigators removed the boys’ bodies Thursday morning. Their 15-year-old brother, who’s now a suspect, was watching them Wednesday while their mother was at a dance recital with three other children.

When the mother returned Wednesday night, she found the 4 year-old dead, then cops discovered the 10 year-old’s body on the lower floor of the house.

“It’s an un-Godly feeling to feel that, I can’t imagine even if it’s not [your kids] so to be in her shoes, I don’t know what I would’ve done,” said neighbor Ann Durrwachter.

After the younger boys’ deaths, the 15-year-old went missing.

Late Wednesday night, Layton Police found him walking about five miles from the home.  Cops took him to the hospital for minor injuries, then arrested him. The teen is now in a juvenile detention facility in Farmington.

Davis County Sheriff Todd Richardson says deputies found evidence that connects the teen to the crime scene.

“He didn’t have any weapons on him but we did find trace evidence of blood on his person,” Richardson said.

Police also say they’ve recovered two murder weapons but they don’t think the crime was premeditated, leaving neighbors to wonder, did the teen snap?

“It’s hard to take in when it comes to kids, it hasn’t really set in,” said neighbor Mitchell Gordon.

The suspect is one of two biological children. There are four other adopted children in the family, including the victims. Police haven’t said if that relationship played a role in the deaths but it’s added to questions neighbors have.

The teen suspect is an honors student at West Point Junior High. Neighbors say he was well-behaved and well-mannered.

“Knowing the older son, you could never imagine him doing something like this,” said Ken Hall.

The kids’ father works with the Air Force and is stationed in Alabama. He’s now on his way back to Utah as investigators continue to gather evidence. The Davis County Attorney may soon be screening the case, deciding whether to file charges.

Texting while driving carries consequences, especially for teens. And sometimes, those consequences are worse than a traffic ticket.

“It is actually the number one killer of teens in America,” said Allstate agent Carrie Batchelor. ”Distracted driving kills over 3,000 people annually and it is attributed to 400,000 injuries.”

Statistics say teenagers are 23 times more likely to crash, due to inexperience and distractions.

West High students found that out first-hand in a simulator on Thursday. Allstate Insurance put on the simulation as part of their tour across the country.

“They get into the car which is an actual vehicle, it’s stationary. They’re behind the wheel using their gas, their brakes, their steering and then they’re challenged to text,” Batchelor said.

The simulator urges teens to put their cell phones down when they’re behind the wheel.

“I knew it was very dangerous but now since I’ve done the simulation I know it’s even more dangerous than I thought,” said student Patrick Armstrong. “It shows what happens when you’re behind the wheel and you’re distracted and driving.”

Here in Utah, teens will get a ticket if they’re caught using their cell phones while driving, thanks to a new law that went into effect last week.

But the West High teens who took part in the simulation say it was enough to scare them out of the temptation.

“Now I definitely know I’m not going to do it,” Patrick said.

Q13 FOX say the collapse occurred on Interstate 5 over the Skagit River near Mount Vernon, which is located about an hour north of Seattle.

Witnesses say it appears that an truck with an oversize load struck the bridge, causing it to bounce and fall. Three vehicles reportedly fell in the water.

People were reportedly sitting on top of their submerged cars as rescue boats scoured the river. Local law enforcement say all victims have been pulled from the river and transported to local hospitals, but a dive team was conducting a final search to see if anyone else was stuck.

The Skagit County Sheriff’s Office says that at least three people have been pulled from the river and taken to a hospital. They are in stable condition. There were no fatalities.

The bridge was built in 1953 and was last inspected in June 2011. At that time, the deck condition and superstructure condition were rated as satisfactory and the sufficiency rating was 54.9 out of 100, Q13 said.

The $19 million facility makes the third veterans’ home in Utah and will serve elderly and disabled veterans in nine southern Utah counties, a population state VA directors say has been long overlooked.

“There are about 12,000 veterans in Washington County and then many others in surrounding counties,” says Utah Department of Veterans Affairs Executive Director Terry Schow. “It means they won’t have to travel to Northern Utah to get skilled nursing care.”

There are 108 beds at the home. It sits on 10 acres of property near the Ivins town center. Land that Mayor Chris Hart says was set aside for this kind of project.

“This is the place that this facility ought to be,” says Hart. “This is a magical, wonderful little city, full of people who love and care about their neighbors.”

But veterans who attended the ribbon cutting say it’s more than just a care facility. The new home will serve as a memorial for veterans who have served.

“It shows that the country cares,” says retired veteran Steve Quintana. “The country cares about the veterans and our health and our cares. And this proves it. This shows it.”

The Department of Veterans Affairs will be opening it’s fourth veterans’ home in Payson on June 8.

FOX 13′s Bob Evans and Hope Woodside were inducted into the Utah Broadcasters Association Hall of Fame this week, so we went through our archives and found some photos of Bob and Hope through the years.

Less than two weeks ago, UFA Deputy Chief Marlon Jones was charged with 14 felonies in connection with prescription drug fraud, and it was announced on Wednesday that paramedic Bruce Bergdahl and another unnamed paramedic will likely face similar charges.

Their arrests came after investigators found that morphine and other pain medication were missing from UFA ambulances and firehouses, and pain medication was taken from ambulances and replaced with saline.

Police first found out about the missing pain medication a month ago, according to Bergdahl’s arrest statement. Their investigation focused on the UFA firehouse in Cottonwood Heights, where detectives then started looking in to employee pharmaceutical histories.

“The theory was that the person most likely had a prescription drug addiction which motivated them,” said Cottonwood Heights Police Chief Robby Russo.

Jones and Bergdahl had both allegedly received several hundred tablets of controlled substances from several different doctors, with the majority of them being oxycodone.

There are no reports that the three suspects were under the influence of those medications while at work.

“We’re going to go back and look at the histories and see if any of their supervisors have ever seen anything while they’ve been on duty. To our knowledge they haven’t,” said Unified Fire Chief Michael Jensen.

Jensen says that they also found no indication that the saline that had replaced the pain medication was injected into a patient.

Jones and Bergdahl are currently on paid administrative leave. Charges from Salt Lake County against Bergdahl and the second paramedic are expected as soon as next week.

(CNN) — An Arizona jury Thursday said it was unable to reach a unanimous agreement and would be unable to decide what penalty Jodi Arias should receive for killing her ex-boyfriend.

That means a new jury will be chosen for the penalty phase of the trial.

Since Tuesday, jurors had been deliberating whether Arias, 32, should get a death sentence for murdering her ex-boyfriend in 2008.

The dramatic trial has lasted for months, sparking a media frenzy and drawing spectators who lined up for courtroom seats.

Earlier this month, the same jurors took less than two hours to decide that Arias was “exceptionally cruel” when she stabbed Travis Alexander 29 times, slit his neck from ear to ear and shot him in the face.

They pronounced her guilty of first-degree murder on May 8 after 15 hours of deliberations.

For Arias to be sentenced to death, the jury’s decision must be unanimous.

About an hour into its deliberations on Thursday, the jury sent out a question, but the details of its query were not revealed in court.

On Wednesday morning, the jury sent out a note saying its members couldn’t agree. Judge Sherry Stephens told them to try again and ordered them back into the jury room.

If Arias is given a sentence of death, she would be the fourth woman on death row in the state of Arizona.

A plea for mercy

On Tuesday, Arias pleaded with jurors to spare her.

She told them she would dedicate her time in prison to performing acts of charity from behind bars. She said she would teach people to read or to speak Spanish, start a book club and donate her hair so it could be used to make wigs for sick children. She showed jurors several pieces of her artwork.

She called Alexander’s murder “the worst mistake” she had ever made, “the worst thing I’ve ever done.” She couldn’t have imagined herself capable of such a grisly crime, Arias told the jury.

“But I know that I was,” she said. “And for that I’m going to be sorry for the rest of my life — probably longer.”

Attorneys argue life, death

Prosecutor Juan Martinez argued that jurors should sentence Arias to death.

“You have a duty, and that duty really means that you actually do the honest, right thing, even though it may be difficult,” he told them.

Defense attorney Jennifer Willmott argued Tuesday that Arias’ life should be spared.

“We’re not talking about whether or not to convict. We’re talking about whether or not to kill. And so when we talk about that, it matters that she was 27 years old and she had no criminal history,” Willmott said. “It matters that she hadn’t done anything wrong in her life before that.”

When Alexander died

Arias was living in Yreka, California, when she met Alexander at a business convention in Las Vegas in September 2006. That November, he baptized Arias into the Mormon faith, a ceremony Arias said was followed by anal sex.

Arias became his girlfriend two months later, she testified. They broke up in the summer of 2007, and Alexander began dating other women.

In June 2008, Alexander missed two appointments, prompting friends to go to his house. They found his naked body crammed in a stand-up shower

He had been stabbed 29 times in the back and torso and shot in the head. His throat was slit.

After her arrest, Arias told an elaborate lie about masked intruders breaking into Alexander’s house and killing him before she narrowly escaped.

Relatives who spoke with police described her as mentally unstable.

The Church’s long-established policy for participation in activities is stated in the basic instructional handbook used by lay leaders of the Church: “young men … who agree to abide by Church standards” are “welcomed warmly and encouraged to participate” (Handbook 2: Administering the Church [2010], 8.17.3). This policy applies to Church-sponsored Scout units. Sexual orientation has not previously been—and is not now—a disqualifying factor for boys who want to join Latter-day Saint Scout troops. Willingness to abide by standards of behavior continues to be our compelling interest.

These standards are outlined in the booklet For the Strength of Youth and include abstinence from sexual relationships. We remain firmly committed to upholding these standards and to protecting and strengthening boys and young men.

The Church appreciates BSA’s reaffirmation of its commitment to “duty to God,” which includes service to others and moral behavior—central principles of our teaching to young men. As in the past, the Church will work with BSA to harmonize what Scouting has to offer with the varying needs of our young men. We trust that BSA will implement and administer the approved policy in an appropriate and effective manner.

A letter signed by the First Presidency of the Church is being sent to all Latter-day Saint congregation leaders throughout the United States. The letter will include the reaffirmation of Church policies and standards referenced in today’s public statement.

The man died when a large bag, weighing at least 2,000 pounds and containing shredded plastic materials, fell on him, according to Jasen Asay from the Salt Lake City Fire Department.

It happened at Mountain Peaks Vinyl, 1878 S Redwood Rd. The manager of the company found the man pinned under the bag about 7:30 am. The man was an employee.

Emergency crews arrived at the scene and attempted to cut open the bag to relieve pressure on the victim, but he had already died.

Officials from the Occupational Safety and Health Administration investigated the incident. The victim’s name has not been released.

The announcement follows a massive landslide that forced parts of the mine to reduce operating costs. The slide happened April 10 at the Bingham Canyon Mine.

The company said the layoffs are from all divisions and are permanent. Kennecott says the workers will be given a severance package. They will also receive employee assistance and access to services with the Department of Workforce Services.

Kennecott says they’re doing what they can do reduce the impacts to its workforce. They are offering vacation time, unpaid leave, and a one-time $20,000 resignation incentive for those eligible for retirement. The deadline for those employees is May 31.

Additional reductions in other parts of the company will take place later this month. The company is still trying to determine how many hourly employees will be laid off.

Anthony Arlen Gardner, 25, walked into the Roosevelt Police Department just after midnight Saturday, and told police he attacked a man at a trailer home near 3000 S 7000 W.

Police went to the home and found 62-year-old Guy Thomas. He suffered a broken nose, severe bruising and a cut to his lower lip.

Gardner told police he had “blind rage mental illness” and did not remember exactly what happened except for hitting Thomas with the hatchet.

Gardner was charged with aggravated assault, criminal mischief and disorderly conduct.

According to a recent study, 71 percent of Life Flight rescues in Utah happen between May and September.

Search and Rescue and Life Flight crews want to remind people that as they head outdoors and into the mountains, to keep safety in mind.

They say when tourists and residents head out to hike in canyons, and play in rivers and lakes throughout the state, the number of calls for search and rescue operations skyrocket. But they say many of those situations can be prevented.

Police say Saad Aljabri was at a party when he tried to run over the people. During the attempts, he hit a parked car twice and ran over the lawn and a mailbox before driving way.

Witnesses say he may have tried to run the people over after he got into a fight with other party goers.

Aljabri was later found at a nearby convenience story. Police say he was drunk. He was booked into the Iron County Correctional Facility on six counts of aggravated assault, DUI, leaving the scene of an accident, and criminal mischief.

Hundreds of members of the Church of Jesus Christ of Latter-day Saints waited outside Temple Square to pay their respects and learn more about the life of Frances Monson. Her daughter said she’ll be remembered as a wonderful mother. In the Church she was beloved by the millions of members.

Family and friends say she was the quiet strength behind her husband.

“President Monson would say she was quiet by nature, but when she talked she had something to say. She was forthright and determined, she loved life, had many friends and served in unheralded ways,” said President Henry B. Eyring, First Counselor in the First Presidency of The Church of Jesus Christ of Latter-day Saints.

Many of those who attended the funeral service didn’t know Sister Monson, but they say they felt like they did because they had seen her in church magazines and beside her husband at General Conference.

“All of the memories and the service that he and Sister Monson have offered in that 50 years is remarkable and very inspiring,” said Adele Parker, an LDS Church member.

Frances Monson’s family says she never complained about the demands placed on her husband to travel and work for the Church. They said she was the one who always packed his bag.

“President Monson once said of his wife, ‘I could not have asked for a more loving, loyal, and understanding companion.’ Whenever he spoke about the miraculous strength of wives and mothers, I knew he was thinking of his sweet eternal companion, Frances,” said President Dieter F. Uchtdorf, second counselor in the First Presidency of The Church of Jesus Christ of Latter-day Saints.

President Monson and his wife were married for 64 years. She died May 17 from natural causes at 85 years old. She leaves behind three children and many grandchildren.

• 2 large yellow bell peppers, cored and quartered
• 2 medium zucchini, sliced lengthwise 1/2 inch thick
• 1 large white onion, cut into 1/2-inch slabs
• 2 ear(s) corn, husked
• 2 tablespoons canola oil
• 1 1/2teaspoons ground cumin
• 1/2 teaspoons crushed red pepper
• 2 cups tomato juice
• 1/2 cups fresh orange juice
• 3 tablespoons fresh lemon juice
• 2 tablespoons red wine vinegar
• 1/4 cup(s) chopped cilantro
• 1 English cucumber, thinly sliced
• Salt Substitute and Pepper, to taste

Light a grill. Thread the garlic cloves onto a skewer. Lightly brush the garlic, bell peppers, zucchini, onion, and corn with the vegetable oil and season with salt and pepper. Grill the vegetables over moderately high heat, turning frequently, until lightly charred and crisp-tender, about 10 minutes. Transfer the peppers to a bowl, cover with plastic, and let steam for 10 minutes.

Meanwhile, remove the garlic cloves from the skewers, peel them, and transfer to a large bowl. Using a large serrated knife, cut the charred corn kernels into the bowl. Peel the peppers and add them to the bowl along with the zucchini, onion, cumin, crushed red pepper, tomato juice, orange juice, lemon juice, and vinegar.

Working in batches, puree the vegetable mixture in a blender or food processor. Pour the gazpacho into a clean bowl and season with salt substitute and pepper. Cover and refrigerate until chilled, about 2 hours.

Just before serving, stir the cilantro into the gazpacho. Garnish with the cucumber.

The report, Rich States, Poor States: ALEC-Laffer State Economic Competitiveness Index, examines the latest trends in state economic growth.

The ranking is based on 15 policy variables, including tax rates and regulatory burdens and labor policies. The report shows that states with lower taxes and fiscally responsible polices have far more economic growth and job creation than other states.

Utah has ranked first in this report for the past five years. Other states with a positive economic outlook include North Dakota, South Dakota, Wyoming and Virginia.

Police raided the Syracuse 6 Theatres as the after-hours show was just getting under way. It was organized by a janitor who worked at the theatre and was looking to make money, Syracuse Police Chief Garret Atkin told FOX 13.

“We had a couple of undercover officers who basically made payment to be observers of the show,” Atkin said Thursday. “We used the SWAT team to help us make entry.”

Syracuse police utilized the SWAT team because they expected as many as 30 people to be in attendance and because it was inside a movie complex. Only six were arrested, Atkin said.Police were initially tipped off about the show, which was taking place after midnight Thursday at the theatre, located at 2428 West 1700 South.

Police allege that Anael Ibanez, 36, who worked as a janitor for a company hired to clean the theatres, had come up with the idea to stage the live sex show. Using Craigslist, Atkin said Ibanez recruited three women to perform, as well as advertising for the show itself.

“He had kind of a tiered schedule,” Atkin told FOX 13. “So they would pay $75 if they wanted to actually be involved in the performance, $50 for a second row seat and $35 for a third. To prove how many people he thought were coming, he told our undercover informants, when they showed up he said, ‘I don’t have any seats left in the first two rows.’”

Police said only six people showed up.”He did tell us he had received confirmation from 50 men that were coming,” Atkin said.

The three women arrested were identified as 19-year-old Krystle Morales; 22-year-old Lillian Scott; and 21-year-old Shelby Boyce. All three were booked into the Davis County Jail on suspicion of sexual solicitation, a class B misdemeanor. Boyce was also booked on a misdemeanor possession of spice and paraphernalia.

Police booked Terrill Holiday, 43, on suspicion of sexual solicitation. Investigators allege he was there to watch the show. Atkin said Troy Manning, 33, was arrested after performing in the live sex show. He was also booked into the Davis County Jail on suspicion of sexual solicitation, possession of a controlled substance, and possession of paraphernalia.

Ibanez was booked on suspicion of distributing pornographic material and exploiting prostitution, both third-degree felonies.

The live sex show stunned officers, who said they had no idea this was even happening down the street from the police station. Atkin said Ibanez had apparently tried to organize a previous show on Sunday, but it didn’t happen because of “lack of participation.”

“This was a first in my career,” the police chief said. “It’s kind of one of those where you get the tip, there’s a moment when everybody says, ‘Oh no way this is happening.’ But then as you start to put the puzzle together, you realize that not only was this happening but theoretically, this is one of those things that probably could have gone unnoticed for an awfully long time.”

Syracuse Police say the management of the Syracuse 6 Movie Theater was cooperative in the investigation and did not know about the live sex show until police notified them.

United Entertainment Corp., the movie theatre’s management, issued this statement:

(CNN) — Openly gay youths will be allowed to join scouting, delegates to the annual meeting of the Boy Scouts of America voted Thursday.

More than 60% of the group’s 1,400-member national council voted in Grapevine, Texas, for the historic policy change, which will take effect January 1.

“No youth may be denied membership in the Boy Scouts of America on the basis of sexual orientation or preference alone,” says the approved resolution.

The BSA will maintain its ban on gay adult leaders.

“The resolution also reinforces that Scouting is a youth program, and any sexual conduct, whether heterosexual or homosexual, by youth of Scouting age is contrary to the virtues of Scouting,” the 103-year-old organization said in a statement.

The BSA said there are no plans for further review of the issue.

“The Boy Scouts of America will not sacrifice its mission, or the youth served by the movement, by allowing the organization to be consumed by a single, divisive, and unresolved societal issue,” it said.

Reaction to Thursday’s vote was swift.

The Human Rights Campaign said the BSA took a “historic step forward.”

“Unfortunately, the new policy does not go far enough, leaving adult Eagle Scouts, scout leaders, and parents behind,” the group said.

John Stemberger, founder of OnMyHonor.net, which opposed the resolution, called the vote a “sad day for Scouting.”

“It is with great sadness and deep disappointment that we recognize on this day that the most influential youth program in America has turned a tragic corner,” Stemberger said. “The vote today to allow open and avowed homosexuality into Scouting will completely transform it into an unprincipled and risky proposition for parents.”

The conservative Family Research Council tweeted: “Sadly, the @boyscouts’ legacy of producing great leaders has become yet another casualty of moral compromise.”

The vote followed months of intense debate among interest groups and within the ranks of Scouting itself.

In February, the Boy Scouts’ national executive board postponed a vote on the issue and ordered a survey of its members.

That survey showed an organization divided by age and, in some cases, by region.

“While a majority of adults in the Scouting community support the BSA’s current policy of excluding open and avowed homosexuals, young parents and teens tend to oppose the policy,” the survey said.

A BSA spokesman called the issue “among the most complex and challenging issues facing the BSA and society today.”

A recent Washington Post-ABC News Poll showed that 63% of Americans said they would support allowing gay youths to join the Boy Scouts.

The vote comes more than a decade after the Supreme Court ruled that the organization has the right to keep out gays but also at a time of declining participation in the American institution.

Membership in Boy Scouts has declined by about a third since 1999. About 2.7 million people now participate nationwide.

The Church of Jesus Christ of Latter-day Saints, after the vote, said it will continue to work with the BSA.

“Sexual orientation has not previously been — and is not now — a disqualifying factor for boys who want to join Latter-day Saint Scout troops,” it said in a statement.

The vote could have an impact in at least two Western states.

The heavily Mormon-populated states of Utah and Idaho reported that if a unilateral change in the policy were to be made, 97% of chartered organizations would probably leave the organization.

The Great Salt Lake Council of the Boy Scouts of America released a statement Thursday, saying:

“The Great Salt Lake Council’s focus remains to deliver the nation’s foremost youth program of character development and values-based leadership training. The information our Council provided on this issue helped provide perspective to the process, and we respect the integrity of the national decision-making process.

“As the Scout Executive of the Great Salt Lake Council, I believe this update to our policy will allow all kids who sincerely want to be a part of Scouting to experience this life-changing program while remaining true to the long-standing virtues of Scouting.

“While people have different opinions about this policy, we can all agree that kids are better off when they are in Scouting. We believe good people can disagree and still work together to accomplish great things for youth. Going forward, we will work to stay focused on that which unites us.”
