Utah woman strikes plea deal in DUI crash that killed 8-year-old boy

PROVO, Utah — A Payson woman has agreed to serve time in prison in exchange for pleading guilty to a reduced charge after she allegedly struck and killed an 8-year-old boy while under the influence of methamphetamine.

A document filed in the 4th Judicial District Court Tuesday shows Tabatha Magoon pleaded guilty to operating a vehicle negligently, causing injury/death and possession or use of a controlled substance.

The operating a vehicle negligently, causing injury or death charge was reduced from a second-degree felony to a third-degree felony as part of the plea arrangement.

The charges stem from a March 20 incident in Payson in which police said Magoon ran over Kaydon Sillitoe, who was riding a skateboard he had received as a birthday gift the day before.

Police said Magoon stopped when she heard screaming and voluntarily submitted to a blood and urine screening.

Magoon faces up to one year in jail and up to five years in prison, to be served consecutively, along with thousands of dollars in fines.

She is scheduled for sentencing on December 7.
