SALT LAKE CITY — A 22-year-old man was formally charged with murder, Tuesday, after he allegedly beat a man with baseball bat after he claims the victim made sexual advances toward him.

The incident occurred on Aug. 9 when Salt Lake City police responded to a unit at the Trolley Place apartment building, 520 S. 500 East, on a report of an assault.

When officers arrived on scene, police say, Andrew Burke Berry IV, told them he was visiting Timothy Houlihan at his apartment when the 39-year-old made sexual advances toward him.

Berry told police he refused, which allegedly made Houlihan angry.

Berry claims Houlihan tried to hit him with a baseball bat, but Berry was able to take it away, according to a probable cause statement.

Police say Berry used the bat to hit Houlihan five times in the head, eventually killing him.

Berry has been charged with first-degree murder. An initial appearance is scheduled for Aug. 22 at 10 a.m.
