Planned Parenthood of Utah to appeal ruling cutting off funding

SALT LAKE CITY — Planned Parenthood of Utah has given notice that it plans to appeal a federal judge’s ruling that allowed Governor Gary Herbert to cut off its funding.

The notice, filed Monday with the 10th U.S. Circuit Court of Appeals in Denver, sets the stage for a larger courtroom showdown over the governor’s authority to block federal pass-through money from the reproductive rights group. Herbert blocked the money after videos surfaced earlier this year alleging executives from the national Planned Parenthood had been involved in talks to sell fetal tissue.

Planned Parenthood has said the videos are highly edited and misleading.

Last week, a federal judge sided with Gov. Herbert and denied Planned Parenthood of Utah’s request for a preliminary injunction while the lawsuit moved through court.
