Appeals court says accused cop killer’s federal charges aren’t double jeopardy

DENVER — A federal appeals court has ruled that an accused cop killer’s latest round of charges do not amount to double jeopardy.

In a short ruling handed down Tuesday, the 10th U.S. Circuit Court of Appeals said Roberto Roman’s federal charges will stand, despite him being acquitted of aggravated murder charges in state court.

Roman was charged in connection with the 2012 death of Millard County Sheriff’s deputy Josie Greathouse Fox, but acquitted by a jury at trial. The U.S. Attorney’s Office then filed charges that included killing a law enforcement officer while fleeing apprehension.
