Judge to decide if Justice Dept. lawsuit against Hildale, Colorado City goes forward

A federal judge will decide if the U.S. Justice Department’s lawsuit against the polygamous border towns of Hildale, Utah, and Colorado City, Ariz., will go forward.

Court records indicate that at the end of a hearing on Tuesday, U.S. District Court Judge H. Russel Holland took a motion for summary judgment filed by lawyers for the towns under advisement, with a promise to rule at a later date.

The Justice Department is suing the towns, accusing them of discriminating against people who are not members of the Fundamentalist LDS Church, which is based on the Utah-Arizona border. The federal government has accused the town governments of acting under orders from imprisoned polygamist leader Warren Jeffs.

Jeffs is serving a life, plus 20-year sentence in Texas for child sex assault related to underage “marriages.”
