Update: Former attorneys general Shurtleff, Swallow now going to court together

SALT LAKE CITY – Former Utah attorneys general John Swallow and Mark Shurtleff will now be going to court together.

Court records on Friday said their first court appearances are now set for the same day, July 30. Swallow was previously scheduled to appear on July 22, but his lawyer did not object to having his initial appearance in 3rd District Court at the same time as Shurtleff.

Court records indicate the two cases have been linked, suggesting that prosecutors may seek to try Shurtleff and Swallow together. They each are listed as co-defendants on charging documents.

Swallow and Shurtleff were arrested Tuesday on corruption charges ranging from bribery to misusing public funds.

Both men maintained their innocence.

Swallow is charged with 13 counts: 

  • Pattern of unlawful activity, a second-degree felony;
  • Accepting a gift; a second-degree felony;
  • Receiving or soliciting a bribe, a second-degree felony;
  • False statements, a second-degree felony;
  • Evidence tampering, a third-degree felony;
  • Misuse of public money, a third-degree felony;
  • Obstructing justice, a third-degree felony;
  • Falsification of a government record, a class B misdemeanor;
  • Failure to disclose a conflict of interest, a class B misdemeanor.

Shurtleff is charged with 10 counts:

  • Pattern of unlawful activity, a second degree felony;
  • Receiving or soliciting a bribe, a second-degree felony;
  • Accepting a gift, a second-degree felony;
  • Accepting employment that would impair judgment, a second-degree felony;
  • Witness tampering, a third-degree felony;
  • Evidence tampering, a third-degree felony;
  • Obstructing justice, a third-degree felony.
