Law firm splits from fundraising group in Amendment 3 case

SALT LAKE CITY — The law firm behind the lawsuit over Utah’s same-sex marriage ban has announced it is breaking from the group that brought the original lawsuit against Amendment 3.

In a statement to FOX 13 on Thursday, the firm Magleby & Greenwood said it has “reached an agreement that releases (Restore Our Humanity) from any
responsibility for past or future legal fees or costs for the Kitchen v. Herbert case
challenging Utah’s Amendment 3.”

Last week, Restore Our Humanity announced it was stepping away from the case as it advances toward the U.S. Supreme Court. ROH originally brought the plaintiffs together with the law firm to challenge Amendment 3.

ROH spokesman Matt Spencer told FOX 13 last week the law firm had racked up nearly $700,000 in legal bills but the group had only raised about $130,000 (minus $30,000 for administrative and event costs).
