Man convicted of murder seeks appeal

SALT LAKE CITY – A man who was sentenced to spend at least 80 years in prison after a fight over $180 turned deadly is seeking an appeal.

Jason Kyle Clark was convicted of killing Kevin Kone, and shooting two women, in a drug deal gone bad in 2007. Both women survived.

Clark is trying to get his conviction overturned, arguing the experts who testified in his case were under-qualified and should not have been used.

Officials with the Utah Attorney General’s Office said the appeal is a waste of tax payer money.

“And so I think even if you throw out that expert testimony, you still got a mountain of evidence tying him to that gun,” Assistant Attorney General Christopher Ballard said. “Plus, you’ve got eyewitnesses saying: ‘He was there. We saw him do this.’”

Clark’s attorney declined to comment after the proceedings.
