Utah Pride Center files brief in Prop 8, DOMA cases

SALT LAKE CITY — The Utah Pride Center has filed a “friend of the court” brief, asking the U.S. Supreme Court to overturn California’s Proposition 8 and the federal Defense of Marriage Act.

“Because the Constitution neither knows nor tolerates classes among its citizens, gay Americans must be treated equally under the law — everywhere,” the brief by lawyers Brett Tolman and Paul Burke reads.

“This Court should affirm the fundamental rights of gay Americans and adopt heightened scrutiny to review laws targeting gay people.”

The brief joins numerous others both for and against same-sex marriage as the nation’s top court plans to hear arguments in March. The Church of Jesus Christ of Latter-day Saints filed a brief opposing same-sex marriage; former Utah Governor Jon Huntsman has joined a brief supporting same-sex marriage.
