Park City Mountain Resort, Talisker to go to trial over lease renewal disagreement

PARK CITY, Utah – A judge decided on Tuesday that Park City Mountain Resort can take Talisker Corp. to a jury trial to decide who will operate the resort.

PCMR filed a lawsuit in March saying that they’d completed the requirements to renew their lease before the deadline, but Talisker refused to renew the lease and was trying to drive the resort out of business.

The judge dismissed six of PCMR’s complaints, but allowed two to go to trial. The first allows PCMR to argue that its lease of the ski terrain had not expired, and the second allows PCMR to seek $7 million in damages for infrastructure improvements made after April 30, 2011, when Talisker says the lease expired.

The judge dismissed other parts of the lawsuit, including claims that Talisker had acted in bad faith and that if Talisker won, it would amount to monopolization under the Utah Anti-Trust Act.
